Terms of Service

1. Who we are
SettleIQ is operated by Cerdas Labs Sdn. Bhd., a company registered in Malaysia under company number 202601002615 (1664712-A), with its registered office at D-03-05 Seni Mont Kiara, 2A, Changkat Duta Kiara, Mont Kiara, 50480 Kuala Lumpur, Malaysia. 2. How ordering works
Submitting the request form is not a purchase and takes no payment. It asks SettleIQ to assess whether a Buyer Folio can be produced for the address given, and to prepare one if so. SettleIQ confirms receipt by email, and — only once the folio is complete — sends a payment link for £400, inclusive of any applicable VAT. A contract to supply the folio to you is formed when that payment is made, not before.
Our order process is conducted by our online reseller, Dodo Payments. Dodo Payments is the Merchant of Record for all orders placed through settleiq.co.uk — that is, Dodo Payments, not Cerdas Labs, is the legal seller of the Folio to you for payment purposes, and Dodo Payments handles payment processing, invoicing, tax compliance, and any payment-related customer service enquiries, refunds, or chargebacks. Cerdas Labs never receives or stores your card details; payment is made on a page hosted by Dodo Payments, reached via the link we email you once your folio is ready.
3. What you are buying
A Buyer Folio is a commissioned research report on one residential address, assembled from public datasets and delivered electronically as a single HTML file by email once payment is received. It is supplied for your own use in evaluating a prospective purchase. This service is available only to individuals aged 18 or over, purchasing in a personal capacity or on behalf of a business they are authorised to bind.
4. What a Folio is not
A Buyer Folio is not a RICS Red Book valuation, a mortgage valuation, a building survey, a structural or condition report, a legal opinion, or financial, investment or mortgage advice. SettleIQ is not regulated by the Financial Conduct Authority and is not a member firm of RICS. A Folio must be used alongside, and never instead of, a physical inspection by a suitably qualified surveyor and advice from your own solicitor and mortgage adviser.
5. Sufficiency
If the registered evidence for your address does not meet the methodology's sufficiency threshold, no offer bracket can be produced. Because this is assessed before any payment link is sent, it carries no financial consequence for you: you are told what evidence does exist and why the threshold was not met, and are simply not asked to pay.
6. Delivery
Folios are ordinarily emailed within 48 hours of your request being confirmed, ahead of the payment stage. Where an address requires manual adjudication you will be told before that deadline expires, not after it. The finished folio itself is sent once payment clears, typically the same day.
7. Your right to cancel
Under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013, you would ordinarily have 14 days after entering a services contract to cancel and receive a full refund. Because a Buyer Folio is fully researched, complete, and delivered to you immediately on payment — there is no gap between contract formation and performance — that standard cancellation period is not practically available for this service.
By ticking the consent checkbox on the request form before any payment link is issued, and again by proceeding to pay once the folio is complete, you expressly request that we begin and complete performance of the contract immediately, and you acknowledge that you thereby lose your right to cancel once the folio has been delivered to you in full. This does not affect your right to a Folio that is not as described, not delivered, or does not conform to these terms — see clause 8.
If you believe your Folio does not conform to what was ordered, contact team@settleiq.co.uk within 14 days of delivery and we will investigate before any further steps are taken.
8. Accuracy and limitation of liability
Public datasets contain errors and omissions outside our control. A Folio reports what the registered record shows at the stated extraction date. Decisions about what to offer, what to borrow and what to sign remain yours.
Nothing in these terms excludes or limits liability for death or personal injury caused by negligence, for fraud or fraudulent misrepresentation, or for any other liability that cannot lawfully be excluded or limited. Subject to that, our total liability to you arising out of or in connection with a Buyer Folio, whether in contract, tort (including negligence) or otherwise, is limited to the amount you paid for that Folio (£400), and we are not liable for indirect or consequential losses, including any change in a property's value, any overpayment on a purchase, or any failed or delayed transaction. This does not affect your statutory rights under the Consumer Rights Act 2015, including the right to a service performed with reasonable care and skill.
9. Intellectual property and use
The Folio is licensed to you for use in your own transaction, including sharing it with your solicitor, broker, surveyor and the selling agent. It may not be resold, republished or used as the basis of a competing product.
10. Complaints and dispute resolution
If something goes wrong, email team@settleiq.co.uk and we will investigate directly. SettleIQ does not currently subscribe to an Alternative Dispute Resolution (ADR) scheme. If a complaint cannot be resolved directly with us, you retain the right to pursue the matter through the courts of England and Wales.
11. Changes to these terms
We may update these terms from time to time, for example to reflect a change in our methodology, our suppliers, or the law. The version in force at the time you submit a request form is the version that applies to that order. Material changes will be reflected in the "last updated" date above.
12. Governing law and jurisdiction
Although Cerdas Labs Sdn. Bhd. is incorporated in Malaysia, these terms, and any dispute or claim arising out of or in connection with them, are governed by the law of England and Wales, and the courts of England and Wales have exclusive jurisdiction over any such dispute or claim. A business incorporated outside the UK may validly choose English law to govern its consumer contracts; where you are a UK consumer, mandatory UK consumer-protection rules apply regardless of this choice, and if you are a consumer resident elsewhere in the UK, mandatory local consumer protections may also entitle you to bring a claim in your local courts.
